Darlings, we have found a complete, unoriginal simpleton on Flickr. It is one thing to poke fun at the absurd and we have no problems with that at all but be original, darling, make your own pictures to prove your point.

This person claims "Yes, I am posting pictures that I didn't take, but I'm just doing it to point out the incredibly ridiculous shit I see in SL and on the SL fash feed."

But, darling, that is a direct violation of the Community Guideline for Flickr.

Don’t upload anything that isn't yours.
This includes other people's photos, video and/or stuff you've collected from around the Internet. Accounts that consist primarily of such collections may be terminated at any time.

His profile claims he is covered by the community guideline citing:
"If you see photos or videos that you’ve created in another member’s photostream, don't panic. This is probably just a misunderstanding and not malicious. A good first step is to contact them and politely ask them to remove it. If that doesn't work, please file a Notice of Infringement with the Yahoo! Copyright Team who will take it from there."

However he must be an idiot for not realizing this is meant for those who unknowingly violate someone else's copyright or intellectual property rights and must have missed that work malicious in there. Sweetheart, you can claim all you want that images are not copyrighted but the Terms of Service also covers other people's photos, video and/or stuff. Stuff us a very board term that covers anything that you did not make yourself. With the daily amount of people reporting your account to Yahoo, your ride into fame will be short lived.

I challenge the real avatar behind About Worst Crap from SL & Fash Feed to be a "man" like you claim to be and put out your avatar name so those people you are stealing from can have a nice chat with you. See, darlings, only cowards hide behind the mask of their stupidity. You can always find me easy enough through my profile. Send me a message and we can talk about violating intellectual property because your friend Zoe did not give you very good advice.

We all know the real reason you hide behind a fake name is so that you do not find your bum banned from locations all across the grid. I have to wonder about the people replying to your ignorance. People like Ryker Beck, Vixie Rayna, Annette Voight, Sonjasi Rau, Creamy Cooljoke, Chalice Carling, Bex Hathaway, ColeMarie, Caliah Lyon, and, the most active one, Elysium Eilde must realize that this type of thing will damage their reputations and possibly their movement in Second Life. These are the very people who support skin creator's intellectual rights when their skins are stolen and here they are supporting a person who steal another's intellectual property. I dare anyone who had their pictures stolen or anyone who finds the whole thing distasteful to ban these individuals from your land.

Wait, let me return to Elysium Eilde. Why do you ask? Looking at her responses and her comments I believe that she is either the Flickr holder or a very good friend of this individual perhaps her SL partner, Jackson Vantelli. Perhaps, only she really knows. Notice her quotes in defense of mocking a freebie skin:
"as you may notice from the name of this stream, this is the worst stuff from SL and the fashion feed, this photo was on the CURRENT fashion planet feed... THAT is why the image was chosen. No one is waging a negative campaign against anyone in particular, it's a campaign against all crap.

This feed is one person's opinion people, you don't have to like it, but you sure as hell have to allow people to comment honestly if they want to."

or her own profile in SL which reads: I say what other people won't.

Eylsium & Company, by all means, wage a war on crap but do it with your own pictures and your own screenshots. Show some originality instead of stealing someone else's pictures. If would take you all of 5 minutes to log in, find that ad, and take a screenshot or, all of 15 minutes, to get the freebie, wear it, and really show what you do not like about it.

I leave you with this thought. Mocking people is great fun but do it legally folks or you will find yourself losing in the end. Also, show your true name.

Update: I asked a commenter their opinion of the situation:
"I don't support this person, but it doesn't mean I can't comment on what's going on. You won't find anything on my comments implying that I think anything else, just that I found that particular caption I posted on amusing. Frankly, that's my comment - there should be a formal statement released on the blogs of the people involved, period."

The problem is that this opens the victim for more harassment. I have had some nice chats in SL with some of the victims in this and they all have the information on reporting the images for take down.

Situation Normal - Butcher It

M Linden addressed the masses today in his blog called A Letter to Second Life Residents. I think that everything he said makes complete sense but, then again, I was all for raising the rates for those abusing the intent of OpenSpace sims.

I am glad to see that the people who use the OpenSpace sims in their original intent can simply contact concierge team by, what I am assuming, the date of the increase, Jan 5, 2009. This is wonderful news for those who were suffering because of the many others abusing the rules of OpenSpace usage.

To appease those with the gripe that they made homes on these sims, LL have added a new product called homesteads which will see a more gradual increase for the rate hike. All OpenSpace sims not in compliance will be changed to Homestead sims and starting Jan 5, 2009 be charged $95 maintenance fee and then in July this will increase again to $125. The Homestead sims will have limits imposed on avatars, prims, and scripts. (More information here.)

I take my hat off to M and Jack because they really bent over backwards to make as many complainers as possible happy. It is clear that my suspicion of the strain on their servers was a large factor in changing these prices and how the OpenSpace system works. The bottom line is that if you do not want to follow the rules there will be consequences.

To those who argued that it was okay to violate the usage for OpenSpace because they gave you so many prims I have this thought to leave you with: I can go to Tesco, WalMart, and the like and buy a butcher knife but this does not mean that I now have to right to go on a killing rampage with the knife because I know this is against the law(rules).

Update: Apparently this is not good enough for some but we know the real reason why. These are the people that have been abusing the OpenSpaces all along and must convert to Homesteads now. In the words of the great one: Deal with it.

A blind person can see that the proof Iris Seale has shown of the stolen Starley skins at PeKashee's. I was present when I few designers tried to talk to the mall owner about removing the stolen vendors and she apparently called in her thug squad. A child sized avatar with a baseball bat and enough blind to make us all legally blind showed up and began beating on poor Ashia Tomsen because she had "horse feet". The people supporting the shop owner tried to claim racial issues because the portray themselves as darker skin avatars.

Lessons in Fraud

According to Mark Dudek at Homeless?: A trustworthy source who has requested anonymity reports that a call to the Federal Trade Commission has confirmed that, from their review of the Openspace Rate Increase matter, a complaint of suspected fraud was “valid”, that all complaints to the FTC are considered anonymous and that personal information is never released, and that “they’d be looking into it.”

If someone from the FTC did say this then they were not given all the facts of the case. "fraud is a deception made for personal gain or to damage another individual." There was never any deception. Linden Lab clearly stated that openspace sims were: for light use only, not for building, living in, renting as homes or use for events.

There was no fraud. They clearly stated what the openspace sims were to be used for and if you used it in another way then that is on you. You are in violation of the Terms of Service and therefore have no one to blame but yourselves.

You can file all the Jiras you want until you are blue in the face but it does not change the facts of the case.

Fact: Openspaces "are provided for light use only, not for building, living in, renting as homes or use for events. As a stretch of open water for boating or a scenic wooded area they are fine, but we do not advise more serious use than this and will not respond to performance issues reported should you not use them in this way."

Fact: Due to the vast number of people improperly using the openspace sims as stated above, Linden Lab has been forced to raise the prices to deal with the strain on their servers. Any company would do this.

Fact: A majority of the people complaining about the rate increase are the very people that caused the rate increase. Most of the complainers talk about their businesses, houses, art galleries, etc. It clearly states it is NOT for that purpose.

Fact: While everyone is frothing at the mouth and threatening, Jack Linden(the very man you all seem to be pointing daggers at) is very willing to listen to complaints despite the fact that many are filled with righteous indignation. He could have said to you all f*&^ off but instead met with you.

In his own words:
"Jack Linden: we have been selling OS regions as a quarter of a normal region. But the land area is the same. So, lets say normal regions have a load of 1, you'd expect Openspaces if used as originally intended to have a load of 0.25. But in fact they have a load of over 0.5. So that really adds up to a lot of extra load on servers with 16 Openspaces on"

If 10 out of the 16 are violating the proper use than the other 4 are really being screwed over by the 10. This is NOT Linden Lab's fault but the fault of the Openspace owners.
